1. PURPOSE AND SCOPE OF APPLICATION

These General Terms and Conditions of Contract govern the purchase of products offered through lifexpan.eu and establish the rights and obligations of LifeXpan® and its customers in relation to such purchases.

Contracting through lifexpan.eu shall be governed by these General Terms and Conditions and by the applicable Spanish and European regulations, particularly those relating to electronic commerce and consumer and user protection.

Before completing a purchase, the User may review these General Terms and Conditions and must accept the conditions applicable to the order.

The applicable conditions shall be those in force at the time the purchase is made, without prejudice to the rights legally recognised to the consumer.

2. ENTRY INTO FORCE

These General Terms and Conditions shall come into force at the moment the USER accesses this website and gives their consent to contract the service and/or product. At that moment, the User fully and unreservedly accepts and adheres to all the general conditions included in this text.

3. PURCHASES AT LIFEXPAN.EU

Access to sales at lifexpan.eu is reserved exclusively for users aged 18 or over.
By accepting these terms of service, the customer acknowledges that they hold lifexpan.eu harmless from any liability arising from the purchase of the product if this breaches the law of the country where the product is sold. The customer is also obliged to check whether the laws/regulations of their country permit or authorise the purchase of the products offered for sale by lifexpan.eu, considering them lawful. The customer therefore expressly indemnifies lifexpan.eu against any breach of the law in relation to the above point, assuming full responsibility.
All lifexpan.eu products are bought and sold exclusively within the territory of the European Union.

lifexpan.eu reserves the right to amend the special conditions of these services, informing the USER in advance.

4. REQUESTING A SERVICE OR PRODUCT

Making a purchase on the website implies the USER's prior knowledge and express, irrevocable, full and unreserved acceptance of these general terms and conditions of sale. Any request made in the name of or on behalf of the USER shall be deemed to have been made by the USER themselves. To conclude the contract for the purchase of one or more products on lifexpan.eu, the user must complete an order form in electronic format and send it to lifexpan.eu electronically, following the instructions that will appear on the website and that will accompany the different stages of the purchase.

The user may correct any data entry errors before confirming the order, following the instructions provided on lifexpan.eu that accompany the various stages of the purchase.

Once the purchase has been made, lifexpan.eu will send an order confirmation to the user. This confirmation will contain a summary of the General Terms and Conditions of Sale and the special conditions applicable to the contract, the characteristics of the product purchased, a detailed statement of the price, information on the right of withdrawal, delivery charges and any additional costs, as well as the contact details of the Customer Service team, whom the user may contact for assistance and/or to lodge complaints.

The language for entering into this contract is Spanish; however, our customer service team can assist Users in Spanish, French and English.

5. PRICE

The price of each product shall be clearly stated on the page where it is displayed, and the price published at the time the order is placed shall apply.

The USER who purchases any of the services and/or products offered on the website must pay the corresponding price by electronic payment or bank transfer to lifexpan.eu. The USER may choose either of these payment methods by indicating it on the order form.

Any applicable taxes arising from the contracting of the services and/or products shall be deemed included in the price of the services shown, unless otherwise stated. lifexpan.eu shall bear the taxes arising from the order, such as Value Added Tax at the percentage rate in force at the time it becomes due.

6. ORDERS AND PRODUCT AVAILABILITY

LifeXpan® will process the order once payment for the price of the products, the applicable delivery charges and any other additional cost previously notified to and accepted by the User has been confirmed.

The products offered on lifexpan.eu include a description of their main features. Images are for illustrative purposes only and there may be slight differences in presentation that do not affect the essential characteristics of the product.

Available destinations, delivery charges, estimated delivery times, delivery methods and the conditions applicable to incidents during transport are detailed in our Shipping Policy, which forms part of the conditions applicable to the purchase.

7. USER REQUIREMENTS

To make a purchase on lifexpan.eu you must be over 18 years of age and provide truthful, complete and up-to-date information during the purchasing process.

The products marketed by LifeXpan® are intended for the use indicated on their labelling, product sheet and the information provided with each product.

The User agrees to use the products in accordance with these instructions and with the applicable regulations.

LifeXpan® may refuse or cancel orders where there are reasonable grounds to suspect fraud, misuse of payment methods, obvious errors in the order or any other circumstance that legitimately prevents the transaction from being completed. Where a payment that needs to be refunded has been taken, it will be reimbursed accordingly.

8. PROTECTION OF PERSONAL DATA

Personal data provided during the registration, purchase or contact process with LifeXpan® will be processed in accordance with current data protection regulations.

9. TERMINATION AND EXPIRY

This contract shall be terminated when both parties have fulfilled the obligations undertaken herein, or when it is terminated by either party if any of the grounds provided for termination arise.

This contract may be terminated by either party if the other party seriously breaches any of the obligations set out in the contract, without prejudice to any claim for damages, including loss of profit, that may arise from such breach.

10. NOTICES AND NOTIFICATIONS

Any notice or notification given by either party must be sent by any method that provides reasonable assurance that the information has been received securely, preferably by email.

11. RELATIONSHIP WITH OTHER CONTRACTS

The relationship between the User or purchaser and lifexpan.eu is governed by these General Terms and Conditions.

Notwithstanding the above, for the purchase of certain specific services and/or products, additional General or Specific Terms and Conditions for that service may be provided to the USER for approval. In such cases, these specific General Terms and Conditions shall take precedence over the relationship between the USER and lifexpan.eu, and these General Terms and Conditions shall apply only in a supplementary manner, insofar as they do not contradict them.

12. INVALIDITY AND PARTIAL NULLITY

Should any provision of this contract be deemed void or unenforceable (in whole or in part) by any competent court, tribunal or administrative body, such nullity or unenforceability shall not affect the other provisions of the contract, which shall remain fully valid and in force.

13. APPLICABLE LAW AND COMPETENT JURISDICTION

These general conditions of sale shall be governed, both for their interpretation and their execution, by Spanish law. The courts of the city of Barcelona shall have sole jurisdiction over any dispute of any nature or issue arising from the formalisation, execution or interpretation of any sales contract concluded between lifexpan.eu and a customer, provided that the customer is not considered a consumer under the definition contained in the current law for the protection of consumers and users.

The User declares to have read, understood and accepted these conditions in full.
